Welcome to NOOK KIDS®.
The terms “we”, “us” and “our” refer to ADBLOOMY Unipessoal Lda., the company operating the NOOK KIDS® brand.
NOOK KIDS® provides this website and online store, including the related information, content, features, products and services (the “Services”), through the Shopify platform.
These Terms of Service (“Terms”), together with the policies and information referred to herein, govern the use of the website and purchases made through the online store.
By using the Services or placing an order, you acknowledge that you have read and understood these Terms. Nothing in these Terms limits or excludes any mandatory rights granted to consumers under applicable law.
SECTION 1 - Access and Account
To make a purchase through our online store, the customer must have the legal capacity to enter into contracts or act through their legal representative.
Certain information may be required to use some features of the Services or to place an order, including your name, email address, billing and delivery address, and information necessary to process payment.
The customer agrees to provide accurate, complete and up-to-date information.
Where a customer account is created, the account holder is responsible for maintaining the confidentiality of their login credentials and for notifying us of any unauthorised use of which they become aware.
SECTION 2 - Our Products
We endeavour to present and describe our products as accurately as possible. However, colours displayed on screen may vary slightly depending on the device, its settings and viewing conditions.
Photographs, descriptions, features, materials, sizes and other information displayed on product pages are intended to represent the goods sold as accurately as possible, without prejudice to minor variations inherent to materials, handcrafted processes or the natural characteristics of the products, where applicable.
Nothing in this section affects the consumer’s statutory rights relating to the conformity of goods.
We may update descriptions, withdraw products from sale or limit available quantities, provided that such changes do not affect orders already accepted by NOOK KIDS®.
SECTION 3 - Orders
By submitting an order, the customer makes an offer to purchase the selected products.
The order is deemed accepted when NOOK KIDS® sends confirmation of its acceptance, without prejudice to any automatic communications relating solely to the receipt or processing of the order.
We may refuse or cancel an order, including in cases of stock unavailability, an obvious pricing or product information error, inability to validate payment, reasonable suspicion of fraud, delivery restrictions or other circumstances that legally or materially prevent us from fulfilling the order.
If an order that has already been paid for is cancelled by NOOK KIDS®, we will issue a full refund of the amounts paid using the original payment method, unless technically impossible or otherwise agreed.
If you wish to amend or cancel an order, please contact us as soon as possible at support@nookkids.pt. We will do our best to accommodate your request while the order has not yet been processed or dispatched.
Returns, refunds and consumer rights are governed by these Terms and by our Returns & Exchanges page.
Purchases made through the online store are, in principle, intended for personal or household use. Orders placed for professional, commercial or resale purposes may be subject to specific B2B terms and conditions.
SECTION 4 - Prices and Invoicing
The product prices displayed on the website are those applicable at the time the order is placed.
Before completing the purchase, the customer will be able to review the price of the products, any applicable discounts, shipping costs, applicable taxes and the total order amount.
Prices, promotions and discounts may be changed at any time, without affecting orders already accepted by NOOK KIDS®.
Depending on the selected market, prices may be displayed in euros or another local currency. Where currency conversion is used, the amount applicable to the order will be the amount displayed at checkout before the purchase is completed.
For orders shipped to countries within the European Union, the prices displayed include applicable VAT in accordance with the legislation in force.
For orders shipped to countries outside the European Union, customs duties, import taxes or other local charges determined by the authorities in the destination country may apply. Unless expressly stated otherwise at checkout, these charges are not included in the price of the products or shipping costs and are the responsibility of the customer.
Shipping costs are displayed separately at checkout and vary according to the destination and applicable shipping conditions.
The customer agrees to provide complete, accurate and up-to-date information necessary to process the order and payment and confirms that they are authorised to use the selected payment method.
Payments are processed through the payment methods made available at checkout and are subject to the terms and procedures of the relevant payment service providers.
The electronic invoice relating to the order will be made available or sent electronically.
SECTION 5 - Shipping and Delivery
The preparation and delivery times displayed on the website are estimates and may vary depending on the destination, carrier, customs procedures or circumstances beyond the reasonable control of NOOK KIDS®, without prejudice to the consumer’s rights under applicable law.
Where NOOK KIDS® arranges the transport, the risk of loss of or damage to the goods passes to the customer only when the customer, or a third party designated by the customer other than the carrier, acquires physical possession of the goods.
If the consumer independently appoints a carrier other than one of the delivery options offered by NOOK KIDS®, the applicable legal rules regarding the transfer of risk will apply.

SECTION 6 - Right of Withdrawal
For distance contracts concluded with consumers, and where applicable law grants such a right, the consumer may withdraw from the contract, without having to provide any reason, within 14 days.
For the purchase of goods, this period begins on the day on which the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods.
Where several goods from the same order are delivered separately, the period begins upon receipt of the last item.
To exercise the right of withdrawal, the consumer must communicate their decision by means of an unequivocal statement, for example by email or post, using the following contact details:

The communication must be sent before the end of the 14-day period.
After communicating the decision to withdraw, the consumer must return the goods without undue delay and, in any event, no later than 14 days from the date on which the decision was communicated.
The address or operational procedure for the physical return of the items will be provided in the return instructions, where applicable.
The goods must be returned in suitable condition, without prejudice to the handling necessary to establish their nature, characteristics and functioning. The consumer is only responsible for any diminished value of the goods resulting from handling beyond what is necessary for this purpose.
Return Costs
For orders delivered to Portugal and Spain, the first return for each order is free of charge. NOOK KIDS® will provide a prepaid UPS return label. The direct cost of any additional returns relating to the same order will be borne by the customer, except in the case of a defective, damaged, incorrect or non-conforming item.
For orders delivered to other European Union countries, NOOK KIDS® will provide a prepaid UPS return label and €10 will be deducted from the refund, corresponding to the customer’s contribution towards the cost of the return.
For orders delivered to the United Kingdom, Switzerland, Norway, United States, Canada, Japan and Australia, the direct cost of returning the goods will be borne by the customer, without prejudice to any mandatory rights granted under applicable law.
In the case of a defective, damaged, incorrect or non-conforming item, return costs will be borne by NOOK KIDS® in accordance with applicable law.
As Little Boxes are sold as sets, they must be returned in full, including all items forming part of the set and the corresponding gift packaging where this forms an integral part of the Little Box.
Any diminished value of the items or packaging resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods may be taken into account in accordance with applicable law.
NOOK KIDS® currently does not offer direct exchanges through the online store. If you would like a different size or colour, you may return the item in accordance with the applicable conditions and place a new order.
Refunds
Where the right of withdrawal has been validly exercised, the refund will be made without undue delay and, in any event, no later than 14 days from the date on which the consumer informs us of their decision to withdraw from the contract.
The refund will be made using the same payment method used for the original transaction, unless expressly agreed otherwise and provided that the consumer does not incur any fees as a result of the refund.
Where legally applicable, particularly where the withdrawal covers the entire order, the refund will include the cost of the standard delivery method originally paid for.
Additional costs resulting from the consumer’s choice of a delivery method more expensive than the least expensive standard delivery option offered by NOOK KIDS® will not be refunded.
NOOK KIDS® may withhold the refund until we have received the returned goods or until the consumer provides evidence that the goods have been sent back, whichever occurs first, unless applicable law provides otherwise.
The right of withdrawal does not apply in cases excluded by law, including, in particular, the supply of goods made to the consumer’s specifications or clearly personalised.

SECTION 7 - Legal Guarantee and Product Conformity
Consumers benefit from the rights provided under applicable law regarding the conformity of goods.
In Portugal, NOOK KIDS® is liable for any lack of conformity that becomes apparent within three years from the delivery of the goods, in accordance with applicable law.
In the event of a lack of conformity, the consumer is entitled, subject to the conditions provided by law, to have the goods brought into conformity by repair or replacement, to a proportionate reduction in the price, or to terminate the contract.
Where a lack of conformity becomes apparent within the first 30 days after delivery, the consumer may, in accordance with applicable Portuguese law, request the immediate replacement of the goods or termination of the contract.
If you receive an item that is defective, damaged, incorrect or otherwise non-conforming, please contact us at support@nookkids.pt, providing your order number and, where possible, photographs that allow us to assess the issue.
The goods will be brought into conformity at no cost to the consumer, including transport costs where applicable.
The statutory rights relating to the conformity of goods are independent of NOOK KIDS®’ commercial returns policy and are not limited by it.
For consumers residing in other countries, any mandatory consumer protection rights provided under the applicable legislation remain unaffected.
SECTION 8 - Intellectual Property
The NOOK KIDS® trademark, its name, logo, visual identity and the content made available through the Services, including texts, photographs, images, graphics, videos, design elements and other materials, are the property of ADBLOOMY Unipessoal Lda., its licensors or partners, as applicable, and are protected by applicable intellectual property laws.
Use of the Services does not grant the user any ownership rights in such content.
Unless prior written authorisation has been obtained or the use is otherwise legally permitted, the reproduction, modification, distribution, public communication, commercial exploitation or use of the website content is prohibited.
Trademarks, trade names and other third-party content displayed on the website remain the property of their respective owners.
SECTION 9 - Third-Party Services and Links
The Services may include features, tools, services or links provided by third parties.
When users access websites or services operated by third parties independent of NOOK KIDS®, they should review the relevant terms and policies. NOOK KIDS® does not control and is not responsible for the content, availability or practices of such independent websites.
This provision does not limit NOOK KIDS®’ liability in relation to third parties it uses to fulfil its own obligations towards the customer, where such liability arises under applicable law.
SECTION 10 - Our Relationship with Shopify
The NOOK KIDS® online store uses technology provided by Shopify.
Purchases made through the store are concluded directly between the customer and ADBLOOMY Unipessoal Lda., operator of the NOOK KIDS® brand, unless expressly stated otherwise.
Shopify provides the technological infrastructure for the store but is not the seller of NOOK KIDS® products.
Nothing in this section affects consumer rights or alters the responsibilities legally attributed to NOOK KIDS® as the professional seller.
SECTION 11 - Privacy Policy
The processing of personal data collected through the Services is carried out in accordance with our Privacy Policy and applicable data protection law.
Shopify and other service providers necessary for the operation of the store may process certain personal data as part of providing their respective services, as described in our Privacy Policy.
We recommend reading our Privacy Policy for detailed information about the personal data processed, the purposes of processing, legal bases, recipients, international transfers, retention periods and data subject rights.
SECTION 12 - Reviews, Comments and Other Content
Where a user voluntarily submits a review, comment, photograph or other content through the Services, the user represents that they have the necessary rights to do so and that the content does not violate applicable law or third-party rights.
To the extent necessary for the operation, display and promotion of the Services, the user authorises NOOK KIDS® to reproduce and display such content, without transferring ownership of the content, and always subject to applicable law, including rules relating to personal data protection and personality rights.
NOOK KIDS® may remove content that is unlawful, abusive, fraudulent or that infringes third-party rights or these Terms.
SECTION 13 - Errors, Inaccuracies and Omissions
Despite our efforts to keep information accurate and up to date, typographical, technical or other errors may occur, including in relation to descriptions, availability, prices, promotions or shipping conditions.
NOOK KIDS® may correct such information when errors are identified.
Where an obvious error makes it impossible to fulfil an order under the conditions displayed, we may cancel the order, inform the customer and fully refund any amounts already paid.
Nothing in this section limits the consumer’s rights under applicable law.
SECTION 14 - Prohibited Uses
The Services may only be used for lawful purposes.
The website may not be used for fraudulent or unlawful purposes, to infringe intellectual property rights or other rights of third parties, to introduce or transmit malicious software, to interfere with the security or operation of the Services, to unlawfully collect personal data belonging to third parties, to transmit unsolicited communications or to carry out any act prohibited by applicable law.
NOOK KIDS® may take reasonable measures to protect the website, its users and third parties against unlawful or abusive use.
SECTION 15 - Suspension and Termination of Access
NOOK KIDS® may suspend or restrict access to the Services where there are justified grounds for doing so, including unlawful or fraudulent use, a serious breach of these Terms, or a risk to the security or operation of the website.
Where reasonably possible and required by applicable law, the user will be informed of the suspension or termination.
Suspension or termination of access to the Services does not affect rights or obligations arising from orders already concluded or any mandatory consumer rights.
SECTION 16 - Availability of the Services
We endeavour to ensure the proper operation and availability of the website and the Services.
However, temporary interruptions, maintenance operations, technical updates or unavailability resulting from circumstances beyond our reasonable control may occur.
We do not guarantee that the website will be permanently available or completely free from technical errors.
Nothing in this section excludes, limits or affects mandatory consumer rights or any legal obligations of NOOK KIDS®.
SECTION 17 - Liability
NOOK KIDS® is liable to the customer in accordance with applicable law.
Nothing in these Terms excludes or limits NOOK KIDS®’ liability where such exclusion or limitation is prohibited by law, including in relation to rights concerning the conformity of goods or damage to life, physical integrity or health, as well as in cases of wilful misconduct or gross negligence.
To the extent permitted by applicable law, NOOK KIDS® will not be liable for losses resulting exclusively from improper use of the products or Services by the customer, failure to follow applicable product use or care instructions, or unforeseeable or unavoidable events beyond our reasonable control, unless otherwise provided by law.
Nothing in this section affects any rights or remedies available to consumers under applicable law.
SECTION 18 - User Responsibility
The user is responsible for using the Services in accordance with the law and these Terms.
The user may be held liable, in accordance with the general rules of applicable law, for any damage caused to NOOK KIDS® or third parties through unlawful, fraudulent or negligent use of the Services.
Nothing in this section imposes obligations or liabilities on consumers beyond those provided under applicable law.
SECTION 19 - Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, this will not affect the validity of the remaining provisions, to the extent permitted by applicable law.
The affected provision will, wherever possible, be interpreted or applied in a manner consistent with applicable law and with its underlying legitimate purpose.
SECTION 20 - Non-Waiver and Entire Agreement
Any failure to exercise or enforce a right under these Terms does not constitute a waiver of that right.
These Terms, together with the applicable policies, pre-contractual information and specific order conditions, constitute the contractual framework governing the use of the Services and purchases made through the online store.
Nothing in this section excludes any information, rights or guarantees that, under applicable law, must form part of the contract concluded with the consumer.
SECTION 21 - Assignment
The customer may not transfer their rights or obligations arising from an order where such transfer is incompatible with the nature of the contract or with applicable law.
NOOK KIDS® may only assign or transfer its contractual position in the circumstances and subject to the conditions permitted by applicable law and without prejudice to the consumer’s rights.
SECTION 22 - Governing Law and Dispute Resolution
These Terms are governed by Portuguese law, without prejudice to any mandatory consumer protection rights that may apply in the customer’s country of residence.
Any dispute will be submitted to the competent courts in accordance with applicable law.
Where applicable, the consumer may also refer a dispute to a competent Alternative Consumer Dispute Resolution entity.

SECTION 23 - Changes to the Terms of Service
The most recent version of these Terms will be available on this page.
NOOK KIDS® may update these Terms where necessary, including as a result of legal, regulatory, technical or operational changes.
Changes will not affect rights and obligations relating to orders already concluded, unless required by applicable law or expressly agreed with the customer.
Where required by applicable law, material changes will be communicated through appropriate means.
